Definitions

App: Refers to this digital application owned and operated by the Company, including any updates or upgrades, used as a platform to access Go for Financing’s products and services.
Company: Go for Financing, a single-person joint-stock company incorporated and registered in accordance with the laws and regulations of the Kingdom of Saudi Arabia, headquartered in Riyadh.
User/Customer: Any person who downloads, accesses, or uses the App in any way to view or benefit from the products or services offered by the Company. By doing so, the user is deemed to have accepted these Terms and the applicable Privacy Policy.
SIMAH: The Saudi Credit Bureau.
Login Credentials: Refers to the username, password, and access keys used by the user to log in to their personal account within the App.

1.Acceptance of Terms

By clicking “Agree,” downloading, or using the app, you confirm that:

You are at least 21 years old (Gregorian calendar).
You have read, understood, and agreed to these Terms and Conditions in full.
You agree to the collection and use of your personal data in accordance with our Privacy Policy.

2.Account and Identity Information

To access financing services, you are required to create a personal user account. By doing so, you acknowledge and consent that:

Your full legal name, as listed on your national ID or residency permit, may be displayed within the app.
The Company may disclose or share your personal data with third parties (such as beneficiaries, partners, or regulators) when necessary to perform our services or where required by law, court order, or regulatory request.
You are solely responsible for safeguarding your login credentials. Any unauthorized access or misuse is your full responsibility.

3.Data Privacy and Consent

We are committed to protecting your personal data in accordance with applicable data protection laws in the Kingdom of Saudi Arabia. By using the app, you agree that:

Your personal and financial information may be collected and used for purposes including eligibility evaluation, financing management, repayment monitoring, and regulatory compliance.
This may include your name, ID number, contact details, income, bank account information, payment history, and credit bureau data (e.g., SIMAH).
Your data may be shared with licensed third-party service providers (e.g., credit assessment agencies, collection partners, digital signature platforms) when required.
Explicit consent will be obtained if your sensitive data is to be used for purposes beyond operational or regulatory needs.

4.Fees and Charges

Certain services within the App may be subject to fees, including but not limited to: processing fees, rescheduling fees, or late payment penalties.
All applicable fees will be clearly displayed before completing any transaction. Upon acceptance, you agree to pay all applicable fees directly to the Company.
The Company reserves the right to amend service fees at any time, with prior notice provided via the App or email, at the Company’s sole discretion.

5.Early Repayment

You have the right to repay the full financing amount at any time before the contractual maturity date.
In case of early settlement, the financing cost may be recalculated in accordance with applicable laws and regulations.

6.Electronic Signature

You acknowledge that all contracts and documents signed electronically via the app are legally binding.
Your digital signature constitutes formal consent and contractual commitment.

7.Collections and Default Handling

In the event of delayed or missed payments, the Company reserves the right to take the necessary legal and procedural actions, including:

Reporting to the Saudi Credit Bureau (SIMAH).
Referring the case to licensed third-party collection agencies.
Initiating legal action before the competent authorities.

8.Notifications and Alerts

You agree to receive notifications related to your financing, account status, payment schedules, or contract updates via SMS, in-app notifications, WhatsApp, email, or phone calls. By accepting these Terms, you grant the Company permission to contact you via these channels regarding your financing, account status, due dates, service changes, and other related matters.

9.User Obligations

You agree to:

Provide accurate, truthful, and up-to-date information at all times.
Use the app for lawful and intended purposes only.
Refrain from impersonating any person or providing false information.

10.Changes to Terms

The Company reserves the right to modify these Terms at any time. You will be notified through the app or email if material changes are made. Continued use of the app after such notice constitutes your acceptance of the updated Terms.

11.Limitation of Liability

The Company is not liable for any direct or indirect losses or damages resulting from the use of the App, including technical failures, service delays, or third-party disruptions.

The Company bears no responsibility for unauthorized access to your account due to your negligence in safeguarding your login credentials.

You agree to indemnify the Company, its affiliates, and related parties for any claims, damages, liabilities, or costs (including legal fees) arising from your misuse of the App or violation of these Terms.

12.Governing Law and Jurisdiction

These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia.

The courts and relevant committees in Saudi Arabia shall have exclusive jurisdiction over any disputes arising from or related to these Terms.

13.Contact

For any inquiries or support requests, please contact our customer care team via the app or through the Company’s official communication channels.

14.General Provisions

If any provision of these Terms is found invalid or unenforceable by a competent authority, the rest shall remain in full effect. Where possible, the invalid provision shall be replaced by one that achieves the same legal purpose.
In the event of a dispute, the Company’s records will be considered definitive evidence of any transactions made through the App.
The Company reserves the right, at its sole discretion, to suspend or terminate your access to the App or any of its services without prior notice if you violate these Terms or for regulatory or security reasons.
